HC-03-3-Malpractice Lawsuits And Insurance Costs

Whereas CLUB 20 recognizes that malpractice lawsuits are a factor that drives insurance costs higher due to:

  • Creating an environment of defensive and overly-aggressive health treatment prescriptions by providers, and
  • Increasing operational costs for providers who pass these costs on to consumers.

Whereas the increased costs of malpractice insurance prevent many health care providers from operating in rural areas;

Now, Therefore be it resolved that CLUB supports non-economic loss caps for damages awarded in medical malpractice lawsuits in order to encourage the affordability and availability of healthcare; and

Be it further resolved that CLUB 20 believes that alternatives to litigation should be developed to ensure appropriate redress for citizens without adding unnecessary costs to the health care system that are not related to delivery of health care.
