AG-06-6-Property Rights and Takings

WHEREAS the 5th Amendment to the United States Constitution guarantees that private property shall not be taken for public uses without just compensation; and

WHEREAS many “takings” result in a partial or complete loss of property values resulting in the disruption of existing uses including agricultural operations; and

NOW THEREFORE BE IT RESOLVED that

  • CLUB 20 supports legislation and policies which reduce regulations and reinforce the 5th Amendment, and prohibits such “takings” without compensation.
  • CLUB 20 supports legislation which would codify the requirement for a “takings assessment” of federal regulatory actions, and which would clarify that the 5th Amendment Takings Clause requires compensation not only for taking title to property, but also for diminishing the value of property.
  • CLUB 20 believes that unreasonably diminished value of property should be considered a “takings” action.
